Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Apex Airwaves (the “Service”), operated by Apex Airwaves (“we”, “us”). By accessing the Service, creating an account, or listening to any station, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & accounts

You must be at least 13 years old to use the Service and at least 18 to operate a station or receive payouts. You are responsible for the security of your account and for all activity under it. Provide accurate information and keep it current.

2. Listening

All stations are free to access. An optional paid upgrade unlocks lossless, ad-free listening across every station. Paid subscriptions renew automatically until cancelled; you may cancel at any time through your billing settings, and access continues until the end of the current period. Except where required by law, payments are non-refundable for partial periods.

3. Stations & broadcasters

Station owners and their team members (“broadcasters”) are solely responsible for the content they broadcast and must hold all rights and licenses required to do so, including any applicable performance and mechanical licenses. Network fees, revenue share, and payouts are described at sign-up and processed through our payment providers. We may suspend or remove any station or content that violates these Terms, our Acceptable Use Policy, or applicable law.

4. Acceptable use

Your use of the Service is subject to our Acceptable Use Policy. You may not infringe others’ rights, broadcast unlicensed content, circumvent access controls, or interfere with the Service.

5. Intellectual property

The Service, including its software, design, and trademarks, is owned by us and protected by law. Broadcasters retain rights in their own content and grant us a limited license to host, process, and deliver that content for the purpose of operating the Service. We respect copyright and respond to notices under our DMCA Policy.

6. Third-party services

The Service relies on third parties for payments, content delivery, and infrastructure. Your use of those services may be subject to their terms.

7. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free.

8. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your content, your use of the Service, or your violation of these Terms or any law or third-party right.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms or to protect the Service or its users.

11. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. (Confirm jurisdiction with counsel.)

12. Changes

We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above, and continued use after changes constitutes acceptance.
